Why Mississauga is different

Mississauga is one of the more homeowner-friendly cities in the GTA when it comes to basement apartments. Registering a second unit costs nothing, and recent zoning changes under By-law 0174-2023 allow many properties to add up to two additional residential units, or even convert to a fourplex.

That flexibility doesn't make the process casual. Every second unit still has to meet the Ontario Building Code, Fire Code, and Zoning By-law, and pass inspection before it goes on the City's public Second Units Registry List. My Legal Basement has built and registered suites across Mississauga, from Streetsville to Meadowvale to Cooksville, and we know how to move a file through cleanly the first time.

What we do

Legal basement services in Mississauga

From the first zoning check to the registration certificate, every stage handled under one roof.

Zoning & eligibility review

We confirm your detached, semi-detached, or townhouse property qualifies, and whether your lot supports one or two units under the newer ARU by-law, including the 1.95 m ceiling-height minimum.

Permit requirements

Professional drawings, an Electrical Safety Authority certificate, 30-minute fire separation with Type X drywall, code-sized egress windows, and the required off-street parking space.

Apartment construction

We build to Mississauga's STC 50 sound-rating requirement on top of fire separation, and plan underpinning before framing if your ceiling height needs to come up to code.

Basement renovations

Not renting right away? We build family rooms, home offices, and in-law space to code, so the space can be converted into a registered second unit later without tearing it out.

Basement finishing

Flooring, drywall and paint, lighting, trim, and bathroom or kitchen fixtures, matched to the rest of your home rather than looking like an afterthought.

Registration & sign-off

We manage Fire and ESA inspections and submit everything to the City, so your unit lands on the public Second Units Registry with a certificate in hand.

The code, in plain terms

What a permit-ready Mississauga suite needs

A building permit is required if the unit is new construction or was built after July 14, 1994. Here's what has to be in place before the City signs off.

The one that surprises people: Mississauga requires an STC 50 sound rating between the second unit and the rest of the house, on top of the usual fire separation. We design for it from the start.

  • Professional drawings & building permitPrepared and submitted for you, with the full permit application managed end to end.
  • Electrical Safety Authority certificateESA sign-off confirming the added load and wiring meet the Electrical Safety Code.
  • 30-minute fire separationType X drywall and a fire-rated door between the suite and the main dwelling.
  • Code-sized egress windowsAt least 0.35 m² of openable area, with no dimension under 380 mm.
  • Minimum ceiling height1.95 m (6′5″) in habitable areas, or 1.85 m under beams and ducts.
  • One additional parking spaceMost second units require one extra off-street space beyond the main home.
The registration path

From your address to the Second Units Registry

Seven steps, in order. We handle the parts that trip homeowners up.

1

Check the City's Find Property Information tool for existing permit history on your address.

2

Obtain a building permit if the unit is new or was built after July 14, 1994.

3

Construction proceeds with scheduled inspections at each stage.

4

Fire Prevention and Life Safety staff inspect the unit; you provide your current Electrical Safety Certificate.

5

Address anything flagged in the Fire Inspection Order and obtain a clearance letter.

6

Email proof of ownership, the signed-off building permit, and the registration form to the City's second units team.

7

The City issues your registration certificate by email, free of charge, and lists the unit on the Second Units Registry.

Why it's worth doing right

Benefits of a legal basement suite

  • Zero registration fee — a lower cost barrier than several neighbouring cities.
  • Rental income that's actually collectible and insurable.
  • Protected home insurance coverage if there's ever a fire or flood.
  • A safe, code-built space for a parent, adult child, or tenant.
  • Higher resale value, since registration status is now a routine question from buyers' lawyers.

Why homeowners choose My Legal Basement

Legal basement apartments are the only thing we build, not a side service squeezed between kitchens. We know Mississauga's STC sound rating and fire separation expectations cold, which means fewer surprises at inspection and a faster path to your registration certificate.

Good questions

Mississauga basement apartment FAQs

Is there a fee to register a second unit in Mississauga?
No. Registration itself is free. You'll only pay for the building permit, inspections, and any required professional design work or construction.
Can I have two additional units on my Mississauga property?
Possibly, depending on your lot size and zoning under the updated additional residential unit by-law. We confirm this during the initial site review.
What sound rating does my basement apartment need to meet?
Mississauga requires a sound transmission class rating of at least STC 50 between the second unit and the rest of the house.
How do I check if a basement apartment is already registered?
Search the City's public Second Units Registry List, or call 311 to confirm registration and permit status for an address.
What if my basement apartment was built before 1994?
A different registration path applies for units that predate the current building permit requirement. Contact the City's Building Division or have us confirm the right process for your property.
What ceiling height do I need for a legal basement apartment?
At least 1.95 metres (6 feet 5 inches) in habitable areas, or 1.85 metres under beams and ductwork.
