Milton Basement Apartment Registration in 2026: Permits, Inspections and Annual Renewal Explained

A completed basement apartment can still have outstanding approval requirements. If you own a basement suite in Milton, check its building permit records and its Additional Residential Unit registration. These are separate processes, and completing one does not automatically complete the other.
Who needs to register
Milton requires all new and existing Additional Residential Units, or ARUs, to be registered. This includes qualifying self-contained basement apartments used by family members as well as rental units. The Town does not provide a registration exemption simply because a unit existed before the program. A recreation room is different from a self-contained dwelling, so confirm how your space is classified.
Building permits and registration serve different purposes
For a new basement apartment, confirm zoning and obtain the required building permit before construction. The permit process reviews the proposed work and includes inspections during construction. ARU registration records the unit and includes checks by municipal law enforcement and fire prevention staff. Paying a registration fee does not replace construction approvals or authorize unpermitted work.
How to register your Milton basement apartment
Start with the Town’s ARU Registry application, available online or through the Community Services Desk at Town Hall. Milton currently lists an initial fee of $340 per unit. Payment must be received before the registration inspection is scheduled. Check the current municipal instructions when applying, because fees and procedures can change.
Prepare for the registration inspection
The registration inspection examines zoning and safety compliance. Prepare by keeping access routes clear, checking alarms, and ensuring furnace rooms and sump pumps remain accessible. Keep approved drawings, permit records and inspection documents together so you can answer questions about the suite. If your basement was finished without approvals, discuss the required correction process with the Town before assuming it qualifies.
Annual renewal is still required
After the unit passes the required inspections, the Town issues a compliance certificate valid for one year. Homeowners must renew annually. During Milton’s three-year pilot, renewals carry no fee; that does not mean renewal is automatic. The Town sends instructions before expiry. Follow the current renewal notice and report alterations that may require further approvals.
Keep a permanent record for your property
Create a folder for your permit, approved plans, inspection reports, registration certificate and renewal confirmations. Add a reminder ahead of the certificate’s expiry date. These records make it easier to track outstanding requirements and explain the suite’s approval history when selling or arranging insurance.
